I do not in any way find the content of the website obscene and/or offensive. Reading, viewing and/or providing content on the website does not in any way infringe the norms or law of my neighbourhood, village, city, county, state or country. 2. Fees/Termination: You are welcome to continue using Social Network as non registered user and in this case you do not have to make any kind of payments. In case if you want to be a VIP user and have access to the VIP features which will fulfill all your needs you should confirm that you come here not by chance, but that you are really interested in communicating with the already-formed group of VIP users. To confirm the seriousness of your intentions you can pay for the VIP access a symbolic fee with one of the offered payment systems: by credit card or by simply sending SMS. Social network reserves the right to terminate your access to the social network for any reason or no reason. Social network may terminate your membership upon sending notice to you at the email address you provide in your application for membership or such other email address as you may later provide to us. If social network terminates your membership in the social network service because you have breached this Agreement, you will not be entitled to any refund of any unused subscription fees. Content Posted on the Social network/CDA: As a social network account holder you may submit Content to the Service, including videos, photos, profile details and user comments. You understand that social network does not guarantee any confidentiality with respect to any Content you submit. For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to social network, you hereby grant social network a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and social network's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in video Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your videos from the Service. You understand and agree, however, that social network may retain, but not display, distribute, or perform, server copies of your videos and photos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable. A) Social network claims immunity from liability to the fullest extent under the law and as provided under the Communications Decency Act for Content provided by third parties and members and nothing in this Agreement is intended to waive, remove, or usurp such immunity. You understand and agree that Social network may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment Social network violates the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Social network and/or its members. B) You are solely responsible for the content that you publish or display (hereinafter, "post") on the Social network, or transmit to other Social network members. C) By posting content to any public area of Social network, you automatically grant, and you represent and warrant that you have the right to grant, to Social network, Inc. and its members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information, rights of publicity, and content and to prepare derivative works of, or incorporate into other works and other media, such information and content, and to grant and authorize sublicenses of the foregoing. As a visitor to Social network if you provide Social network with your e-mail address via a registration process or post it on Social network you thereby authorize Social network and its affiliates and any entities that Social network becomes involved with or merges with, the right to use your valid email address for any marketing programs or communications with you. D) The following is a partial list of the kind of content that is illegal or prohibited on the Social network. Social network will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the service and terminating the membership of such violators. It includes content that: is patently offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; harasses or advocates harassment of another person or invades their privacy; involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"; promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page); displays pornographic or sexually explicit material of any kind or provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18; provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes. E) You must use the Social network service in a manner consistent with any and all applicable laws and regulations. 5. Member Disputes: Social network does not control the information provided by other users that are made available through our system. If in any way you find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and safety when using Social network and inform administrator about the violations you found. You are solely responsible for your interactions with other Social network members. Because it is not involved in member interactions, in the event that you have a dispute with one or more members or those who have posted, viewed, or used information on the Social network, you release Social network including its officers, directors, agents, subsidiaries and employees, from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code ?� 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." Social network reserves the right, but has no obligation, to monitor disputes between you and other members. 6. Privacy: Use of the Social network and/or its service is governed by our Privacy Policy which may change from time to time upon electronic notice to you. 7. Disclaimers: Providing or supporting escort services, prostitution, giving out personal information (including e-mail addresses outside Social network, online instant messenger IDs, postal addresses, invoice numbers etc.), arranging personal appointment with a Customer is prohibited. Owners of the Social network cannot be held responsible for any damage or loss originating from personal contact with Customers outside Social network. Social network including its officers, directors, agents, subsidiaries and employees is not responsible for any incorrect or inaccurate content posted on the Social network or in connection with the Social network service, whether caused by users, members or by any of the equipment or programming associated with or utilized in the service, nor for the conduct of any user and/or member of the Social network service whether online or offline. Social network assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user and/or member communications. Social network is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Social network and/or in connection with the Social network service. Under no circumstances Social network be responsible for any loss or damage resulting from anyone's use of the Social network or the service and/or any content posted on the Social network or transmitted to Social network Members. The Social network and the service are provided "AS-IS" and Social network expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Social network cannot guarantee and does not promise any specific results from use of the Social network and/or the Social network service. Use of obscene words, threatening or quarrelling with, or violating the rights of visitors, Customers, Social network support persons or management of the Social network is prohibited. Advertising other websites or services is strictly prohibited. 8. Limitation on Liability: Except in jurisdictions where such provisions are restricted (and in that event liability is disclaimed to the fullest extent permitted by law), in no event will Social network be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Social network or the Social network service, even Social network has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Social network liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Social network for the service during the term of membership. 9. Arbitration of Disputes: Any and all disputes arising out of these Terms of Use and/or your relationship with Social network shall be submitted to the binding arbitration according to the rules of the American Arbitration Association. The parties to the arbitration shall evenly divide any and all costs of the arbitration. Neither party shall be entitled to attorney fees. The arbitration shall take place exclusively in Las Vegas, Nevada and shall be governed by Nevada law without regard to its conflict of law provisions. 10. Indemnity: A) You agree to indemnify and hold Social network its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above. B) Notices/Other: Except as explicitly stated otherwise, any notices shall be given by Contact page. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, Social network may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to Social network during the registration process. In such case, notice shall be given 3 days after the date of mailing. You agree that this Agreement and all incorporated Agreements may be automatically assigned by Social network in our sole discretion, to a third party. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. References to Social network shall include its subsidiaries, affiliates, officers, agents, and other partners and employees. Social network failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. C) Information Collection: Visitors can access our Social network and browse our Social network without disclosing any personal data. However, in order to provide you with a particular product or service online, Social network may request that you voluntarily supply Social network with primary personal data (such as name and email address). Social network receives and stores all information that you enter in our Social network. In addition, Social network collects information about you during your visit, such as your IP Address, and Social network employs its software in order to ascertain your physical location. However, we do not collect information from other sources, such as public records or bodies, or private organizations. You are required to provide Social network with accurate and up-to-date information, and failure to provide Social network with such information could result in voiding your Agreement with Social network. Social network will not sell, share, or rent this information to third parties in ways different from what is disclosed it this policy. Social network shall release data when required by law, to enforce its Agreement, or the contract rights of its clients. Social network shares the following data with the owner/operator of the Social network from which you are purchasing services utilizing Social network services: your e-mail address, your name, your address, your phone number, your date of birth, and your agreement to be bound by Social network terms and conditions. Social network uses the data it collects for the technical administration of the Social network, research and development, and fraud deterrence. E) Information sharing: We ensure that your personal data will not be disclosed to State institutions and authorities except if required by law or other regulation. F) Email correspondence: Social network may request a confirmation when you receive and open and e-mail communication delivered by Social network. We archive and identify the origination IP address of all email sent into our network. G) Third party information: Occasionally, Social network receives information from third parties to compare it to information that you had provided to Social network for fraud prevention purposes. H) Cookies: A cookie is a piece of data stored on the visitor's hard drive containing information about the visitor. Social network employs "cookie" technology. We use Cookie to store personal date, to authenticate you as a Social network user, for security purpose, and to track our affiliate click-throughs and sign-up rate. I) Security: We date every protection to protect our visitors' information. Refund policy: A) Donation is your help for site developing and managing. Donation is not mandatory, this is only your good wish to help web site and refund is not possible. B) Refund of credits added on the site is not possible. Credits transferred by you to other member are your gift and it doesn't matter what exactly you discussed with this member. Credits transfer to another member is made by you and its your decision. Refund of those credits to your balance is possible only by discussing it with this certain member. Site administration is not responsible for non-parties of such agreements, and don't participates in debates. Before you made the credits transfer discuss all conditions with the recipient.
